Congress happy in Mangalore, High Court allows municipal candidate to contest election, nomination was cancelled on charges of encroachment on Nazul land

Nainital: Uttarakhand High Court has stayed the Election Officer’s order of cancelling the nomination of Congress’s authorized candidate Mohammad Islam for the post of Mangalore Municipality President and has restored his nomination. The High Court directed the Election Commission to include the name of the petitioner in the ballot paper and said that if the petitioner gets the maximum votes in the counting, then the decision on it will be subject to the decision of the court.

Nomination was rejected on charges of encroachment on Nazul land

The nomination paper of Congress candidate from Mangalore Mohammad Islam was rejected by the Election Officer on charges of encroachment on Nazul land, while Islam says that he was not given time to present his side in this matter. He had challenged the order of the Election Officer in the Single Bench of the High Court, which was rejected by the Single Bench on January 7. Against which he had appealed before the Division Bench.

High Court stays order of Returning Officer

A special bench of Justice Ashish Naithani was constituted to hear this case. Senior Supreme Court advocate Salman Khurshid and advocate Siddharth Shah argued the case. After hearing all the parties in the case, the High Court accepted that the petitioner’s rights have been violated by the decision of the Election Officer. On this basis, the order of the Returning Officer rejecting his nomination has been stayed and instructions have been given to include his name in the ballot paper.
