Uttarakhand: Contract workers till 4 December 2008 may be regularized, meeting held regarding new rules

Dehradun: Regularization of employees employed on contract till 4 December 2008 in Uttarakhand may be done. For this, the Regularization Rules 2025 will soon be placed before the cabinet. Under the announcement of Chief Minister Pushkar Singh Dhami, a committee meeting was held on 28 August under the chairmanship of Chief Secretary Anand Bardhan. Secretary Personnel Shailesh Bagauli, Secretary Finance Dilip Jawalkar, Additional Secretary Justice Manish Kumar Pandey, Additional Secretary Personnel Navneet Pandey, Additional Secretary Finance Ganga Prasad attended the meeting.

It was told in the meeting that in the light of the instructions of the Supreme Court in the state, the rules for regularization of daily wages, chargeable, contract, fixed pay, part-time and ad-hoc appointed personnel were issued under one time exercise. Under this, a provision was made to regularize the personnel who completed 10 years of service on November 1, 2011. After this, Regularization Rules 2013 were brought on 30 December 2013, which made provision for regularization of those who had at least five years of continuous service on 30 December 2013. This was stayed by the High Court Nainital in 2018.

The order was revisited

After this, the High Court Nainital gave an order on 22 February 2024 on the Narendra Singh vs State writ petition, stating that the limit of five years should be made 10 years. This order was revisited. It has been decided that a proposal will be prepared to regularize the daily wage, work charge, contract, fixed salary, part-time and ad-hoc appointed personnel 10 years before the High Court’s stay order on December 4, 2018, i.e. till December 4, 2008. Under this, by amending sub-rule-1 of rule four of the 2013 rules, the Regularization Amendment Rules 2025 of daily wage, chargeable, contract, fixed pay, part-time and ad-hoc appointed personnel will soon be placed before the cabinet. After this the cabinet will take a decision on it. Another important thing here is that regularization will be done only under the rules that are already in place. Employees of outsourcing agencies like Upanal will not be included in this.
